Terms and Conditions

Program Description

Mercury Opinion (“we,” “us” and “our”) is a nonpartisan organization that conducts public research to understand key issues and trends in America.  Relevant here, we use mobile messaging and telephonic channels to conduct surveys and poll members of the public on topics such as healthcare, current events, politics, spending habits, etc. (the “Program”), subject to these Mercury Opinion Mobile Messaging Program Terms and Conditions (the “Terms”).  The Program allows participants to receive, without limitation, recurring informational messages seeking responses from Program participants.  By providing your personal information when presented with a link to, or other notice of the existence of, these Terms, you agree that you are bound by these Terms and agree to receive communications from Mercury Opinion, including SMS, MMS, voice and email.  

User Opt In

The Program allows you to provide your contact information, including, but not limited to, your telephone number, so that we may contact you in the future using the contact information you provided.  The Program allows users to receive, among other communications, SMS/MMS informational mobile messages from Mercury Opinion’s short code(s), including 40850.  Users must affirmatively opt into the Program, such as through opting in through a website form, or by becoming a registered panelist with Mercury Opinion. Any telephone or mobile messaging service used by the Mercury Opinion to communicate with you does not have the capacity to randomly or sequentially generate telephone numbers.  Thus any mobile messages and telephone calls encompassed by these Terms are not sent to you by an automatic telephone dialing system (“ATDS” or “autodialer”).  Nevertheless, by participating in the Program, you agree to receive automated and/or prerecorded calls or text messages from Mercury Opinion. 

Cost and Frequency

Message and data rates may apply.  The Program involves recurring mobile messages, and additional mobile messages may be sent based on your interaction with Mercury Opinion.

User Opt Out

If you no longer wish to receive communications sent on behalf of Mercury Opinion and wish to opt out of such communications, you can revoke your consent by asking to be placed on Mercury Opinion’s Do-Not-Call list.  To opt out of receiving text messages from Mercury Opinion, reply “STOP” to any Mercury Opinion message.

MMS

The Program will send SMS MTs if your mobile device does not support MMS messaging.

Privacy Policy

As a nonpartisan organization that conducts public research, Mercury Opinion may use and share the information you provide to us with organizations that have engaged us to conduct polling or surveys on their behalf, as well as third parties that perform services on our behalf.  In addition, subject to applicable law, we may share any of the personal information that we collect about you with certain third parties that share our interests. We reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. This Privacy Policy is strictly limited to the Program and has no effect on any other privacy policy(ies) that may govern the relationship between you and Mercury Opinion in other contexts.  

Warranty

 Mercury Opinion will not be liable for any delays or failures in the receipt of any mobile messages connected with this Program. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator, and is outside of Mercury Opinion’s control.

Miscellaneous

Mercury Opinion reserves the right to change these Terms from time to time and will post any changes to this page on its website. The date at the bottom of this page indicates the last time changes were made. You acknowledge your responsibility to review these Terms from time to time and to be aware of any such changes. If we make material changes to these Terms, we will provide you with notice as required by law.  Your continued participation in the Program will signify acceptance of the updated Terms.
